West Virginia Marijuana Laws

The progression of WV marijuana laws over the past few years has been a bit of a roller coaster. The state’s laws are finally stable, providing MMJ patients with the plant medicine they need.

Under the WV Medical Cannabis Act, Senate Bill 386, West Virginia marijuanas legalized for medical use in 2017. In 2019, the state finally started registering MMJ patients. 

But, there were continued delays due to banking issues and other uncertainties. In 2019, the legislature passed a bill that allowed credit unions to bid for the state’s account, helping to solve those banking issues.

It wasn’t until the end of 2021 that West Virginia opened its first medical cannabis dispensary in Morgantown and began selling cannabis products.

Still, West Virginia is one of the 19 states that have yet to decriminalize cannabis possession. In WV, possession of cannabis could result in a misdemeanor punishable by a fine of up to $1,000 and up to six months in prison. 

West Virginia marijuana laws also state that:

  • The Medical Cannabis Act protects you from arrest and prosecution if you abide by the regulations provided by the act.
  • Patients and caregivers may possess up to a 30-day supply of cannabis, but WV law doesn’t specify the amount. The physician's certification will define what a 30-day supply entails.
  • At-home cannabis cultivation, or growing weed plants in your residence, is illegal.
  • Like most states, WV prohibits public consumption of cannabis in any form.
  • WV dispensaries cannot sell edibles, but there are no laws against making edibles yourself.
  • West Virginia does not have medical marijuana reciprocity, meaning it does not accept MMJ cards from other states. There are exceptions for terminally ill patients.
