The road to legalization began in 2014 when the Missouri legislature passed HB 2238. The bill created the Missouri Hemp Extract Registration Program (MHERP) and allowed state residents diagnosed with severe epilepsy to buy and use hemp extract that contains no more than 0.3% THC. 

The state reached another marijuana landmark in 2014 with Senate Bill 491, which reduced the charge for possessing small amounts of cannabis. The new law reduced possession of 10 grams or less of marijuana to a misdemeanor punishable by a fine and no jail time. 

Medical marijuana arrived via the ballot on November 6, 2018, when voters approved Amendment 2, a ballot initiative to legalize medical marijuana. The Department of Health and Senior Service oversees Missouri medical marijuana regulations.

Patients may buy up to four ounces of dried, unprocessed marijuana or its equivalent within 30 days. However, patients who want to buy a higher amount require two independent physician certifications.

According to Missouri cannabis laws, medical marijuana refers to cannabis and cannabis-infused products that contain THC levels above 0.3%.

Products that contain cannabis or hemp or chemicals derived from cannabis or hemp but with THC content below 0.3% are not medical marijuana.

You can use Missouri medical marijuana in different ways, including vaping, smoking, tinctures, oils, bath salts, edibles, capsules, sprays, lozenges, strips, and salves.

It is illegal to drive with any amount of marijuana in your system, even if you have a Missouri medical marijuanas card. A first-time DUI offense is a Class B misdemeanor and carries a maximum fine of $500, a 30-day license suspension, and a maximum jail time of six months. 

Can Medical Marijuana Patients Buy and Own Guns?

Missouri marijuana law does not prohibit MMJ card holders from buying or owning guns. However, federal laws can prohibit marijuana users from purchasing and possessing guns even if medical marijuanas in Missouri is legal.

According to the Department of Health’s website, “The Department of Health and Senior Services does not regulate the possession or purchase of firearms and therefore cannot say how federal prohibition will be enforced within Missouri.”

You need to note that even if you have a Missouri medical marijuanas card, you can’t buy medical marijuana anywhere you like.

Missouri marijuana law states, “Only dispensaries licensed by DHSS are authorized under Article XIV to sell medical marijuana, which must pass testing requirements to ensure safe access for licensed patients.”

You’re protected by Missouri marijuana laws only when you buy from establishments with a valid Missouri dispensary license. Also, licensed dispensaries undergo rigorous product tests to ensure patients get only safe and quality products.

Where Can I Smoke Weed With My Medical Card in Missouri?

The one thing you’re sure you can do with your Missouri medical marijuana card is to buy and consume marijuana. However, your card is not a blank check, and there are still limits and restrictions.

Missouri marijuana law explicitly states that “no qualifying patient shall consume marijuana for medical use in a public place unless provided by law.” Public space here includes any space open to the public like sidewalks, bridges, streets, schools, businesses, and parks.

If the authorities catch you consuming marijuana in any of these places, it’s a marijuana offense. It’s best to consume marijuana in the privacy of your home.  

Can Medical Marijuana Patients in Missouri Grow Their Own Marijuana 

Can you grow marijuanas in Missouri? Yes, but before you go off to start planting, there’s more you need to know.

Usually, in states where patients can grow their own marijuana, there are regulations such as plant limits, where you can grow your marijuana, and others. 

Before you can grow marijuana, you need a growing license in Missouri.

No, it’s not the same as your medical marijuana card. However, our cultivation license is valid as long as your medical card remains valid. 

Missouri Cultivation License Rules

To grow marijuanas in Missouri, you should stick to these rules.

  • Patients licensed to grow marijuanas in Missouri can grow up to six flowering plants, six non-flowering plants, and six clones in a secure and enclosed facility. 
  • The patient or their qualifying caregiver must be in possession of the plants at all times, and the plants must be labeled with the patient’s name.
  • Marijuana cultivation must take place in an enclosed, locked facility.
  • Only the patient and their caregiver should have access to the cultivation space. 
  • Only two individuals who have valid cultivation licenses can share a cultivation space

How to Become a Medical Marijuana Caregiver in Missouri

But, only legal guardians or parents can serve as licensed caregivers for minors.
