It’s important to understand what the rules and regulations are when it comes to medical marijuana in the state you are residing in or planning on visiting. This will allow you to be prepared and not be surprised by any of the guidelines when they come up.

What Are the Oklahoma Marijuana Laws?

In 2018, Oklahoma officially made medical marijuana legal when voters approved Oklahoma State Question 708. 

Of course, with the legalization of medical marijuana comes some stipulations, which are important to understand before trying to get a prescription for yourself.

Any Oklahoma resident 18 or older who has a recommendation from an Oklahoma licensed physician is able to apply for a medical marijuana card

There are some exceptions made for those under 18 or those who are not currently residents of the state. However, those are determined on a case-by-case basis and are applied for using separate applications.

It’s also important to know the medical marijuana card laws in Oklahoma

If you are a medical cardholder, you are allowed to have three ounces of marijuana on your person and eight ounces at your place of residence. It’s important to know these amounts and abide by them as a cardholder.

It’s also important to know the purchasing limitations on medical marijuana cards. Cardholders are only allowed to purchase certain amounts per transaction. Those amounts include:

  • Three ounces of marijuana flower
  • One ounce of marijuana concentrate
  • 72 ounces of cannabis edibles
  • Six mature marijuana plants (harvestable and flowering)
  • Six marijuana seedling plants (no flowers)

While these are the restrictions per transaction, it’s important to note that they are also the restrictions on how much of each form a cardholder can have in their possession at a time.

If you’re wondering who handles the enforcement of these laws and regulations, that would be the Oklahoma Medical Marijuana Authority (OMMA). 

OMMA is also in charge of reviewing, approving, and monitoring all medical marijuana licenses that are handed out in the state of Oklahoma. When it comes to marijuana laws in Oklahoma, they are the end-all of handling them.

As of now, recreational marijuana is still illegal in the state of Oklahoma. However, there are a couple of groups who are working to change that. As of April 2022, there were two state questions aimed at bringing recreational legalization to a vote in November. Unfortunately, these efforts were unsuccessful that year. 

However, regardless of what the future is, right now it’s illegal to have any marijuana on your person unless you have a medical marijuana license in Oklahoma. 

While Oklahoma recreational marijuana laws may be changing soon, it’s important to follow the current laws and guidelines of the state.

Oklahoma Commercial Grow License

As of January 2022, nine percent of Oklahoma residents hold a medical marijuana license, and the business is currently booming throughout the state. If you’ve found yourself wondering if you can become a commercial element in the business of medical marijuana, there are some steps you can take.

The Oklahoma Medical Marijuana Authority (or OMMA) handles all commercial grow licenses. As of right now, it is still incredibly easy to become a commercial grower of medical marijuana in the state, and it is a growing area of agriculture.

However, in an effort to keep the business pure to its original intentions, there is now a limit on the number of medical marijuana grow licenses that will be given out at any given time. 

So, if you’re interested in becoming a commercial grower of medical marijuana, now is the time to act.

It is also important to recognize that those who hold a commercial grow license are only allowed to sell their marijuana crops to licensed dispensaries or processors. Selling to individuals without a dispensary license would be breaking the contract of the grow license.

How Many Plants Can a Commercial Grower Have in Oklahoma?

Believe it or not, there is currently no limit to the number of cannabis plants you can grow as a medical marijuana commercial grower in Oklahoma. 

In fact, there is actually a minimum number of plants you have to grow in order to keep your commercial grower license.

When House Bill 2272 was signed into law in 2021, it required commercial growers to be cultivating at least 50 medical marijuana plants per month in a twelve-month period. Keep in mind that this number is meant to be a rolling average for that twelve-month period, in order to make up for any months where growth may be limited by weather or climate.

How to Get a Grow License in Oklahoma

If you would like to obtain a medical marijuana grow license for Oklahoma, there’s a set of qualifications you must meet before you can apply. Those qualifications include:

  • Applicants must be 25 years old or older
  • Applicants must be a resident of the state of Oklahoma
  • Applying entities must prove they are at least 75% owned by Oklahoma residents
  • Applicants must pass a background check

Also, as of 2019, no one can apply for a growing license in Oklahoma who is a sheriff, deputy sheriff, police officer, prosecuting officer, OMMA officer or employee, or a municipality in the city or county where the proposed cultivation would occur.

When applying, applicants must also pay a $2,500 application fee which is required to be paid to OMMA in order to have the application processed. 

Once received, commercial growing licenses are valid for one year from the date of issue unless they are revoked by OMMA for violation of the rules and regulations.

Oklahoma Growers License Application

If you meet the above requirements for a grower license, then you are able to send your application to OMMA. When applying for a grower license, be aware that OMMA quotes a 90-day turnaround time for all applications. 

If your application is not approved due to not providing all the required information, you have thirty days to send in the information requested.

Current growers are also required to send in renewal applications in order to keep their licenses up to date with OMMA. 

When applying for renewal, know that the application needs to be sent in before the expiration date of your current application but not more than 60 days before. If you miss your deadline for renewal, you will have to pay a $500 fee to make up for the delinquency.

Part of the application includes a Certificate of Compliance, which must be filled out and sent in with the application to OMMA. 

This certificate must be approved by the appropriate jurisdiction (usually a city or county) where the marijuana growing will take place. If an applicant fails to have this certificate approved before sending in their application, they risk either delaying their application or having the application denied altogether.

Before sending in your application, OMMA recommends going through their Commercial License Application Checklist and ensuring you have taken all the steps needed before sending in your application. Doing so will help avoid delays in your application processing.

OMMA Dispensary Laws

Another entity of the medical marijuana business in Oklahoma is dispensaries. Dispensaries are another element of medical marijuana that OMMA oversees throughout the state of Oklahoma and they have their own laws to abide by.

Dispensaries in Oklahoma must be at least 1,000 feet from both public and private schools. 

This measurement is taken in a straight line where the shortest distance between the two locations is. They also can only sell to people who have a valid Oklahoma medical marijuana license. 

Dispensaries are unable to sell to anyone who shows an out-of-state medical marijuana card.

Currently, dispensaries are allowed to sell marijuana flowers, edibles, concentrates, seedlings, and mature plants to medical cardholders. No other form of marijuana is currently legal to be sold at licensed dispensaries.

Finally, all products must be properly labeled with the correct warnings, guidelines, and product information required for each batch of cannabis. 

Packaging is not allowed to showcase the OMMA logo or have designs on it meant to attract minors.
