Is recreational weed legal in Illinois? Luckily for casual cannabis users, the answer is yes. Marijuana was officially legalized for recreational use in 2019 and recreational sales started in January 2020. Medical marijuana has been legal since 2013 and was expanded in 2019. Although recreational marijuana is now legal, medical cardholders can purchase marijuana at lower price points and receive priority in the event of a marijuana shortage. 

Many people wonder – is marijuana decriminalized in Illinois? The short answer is yes – the state was in the process of decriminalizing marijuana even before it was legalized recreationally. However, there are still some instances where you can face legal consequences for marijuana possession. This can happen if you are carrying more than the legal possession limit, are carrying marijuana underage, or are using marijuana in a place where it isn’t allowed. You can also face legal consequences if you grow marijuana without a medical card or attempt to sell it privately. 

How much cannabis can you possess?

How much weed can you have in Chicago? Anyone over the age of 21 can purchase recreational marijuana products, but Illinois marijuana possession laws still limit exactly how much you can have at one time. Right now, recreational users can have up to 30 grams of marijuana flower at one time. They can also have up to 5 grams of marijuana oils or concentrate and up to 500 grams of THC in an infused product, such as edibles.  

If you have a medical card, you can purchase much larger quantities of marijuana. Medical cardholders are allowed to buy up to 71 grams of cannabis in a two-week period. If you have a specific medical condition that requires a larger quantity, Illinois does grant waivers for some patients. 

Age Limit for Possession

You must be 21 or older to use cannabis recreationally in Illinois. However, the age limits are slightly different for medical patients. You can apply for a medical marijuana card on your own if you are 18 or older, but if you are under 18, your parent or guardian can apply for a medical marijuana card for you. In this case, your caregiver would be the one visiting the dispensary for you. 

Can you grow your own weed in Illinois? 

You can currently only grow your own marijuana in Illinois if you are a medical marijuana cardholder over the age of 21. 

You cannot sell or share the plants you grow in your home – they are only available for personal use. It’s also important to note that if you rent your home, you will need permission from your landlord in order to legally grow marijuana plants. 

How many plants can you grow? 

Medical marijuana cardholders can grow up to five plants in their apartment. These plants can be at least five inches tall and must be stored in a secure location that isn’t visible to the public.

Where To Buy Marijuana in Illinois

Wondering where to buy recreational weed in Illinois? Don’t worry – there are plenty of dispensaries located throughout the state. These dispensaries are privately run but are licensed by the state. 

In Chicago alone, there are 10 dispensaries to choose from, many of which are accessible by public transportation. There are also dispensaries located in major cities and towns throughout the state, including Rockford, Peoria, Springfield, and Champaign, just to name a few. While most of these dispensaries are licensed for recreational sales, some only offer medical sales, so be sure to check before you visit the dispensary. 

Age Limit for Buying Marijuana

How old do you have to be to buy weed in Illinois? You must be at least 21 to purchase marijuana recreationally and at least 18 to purchase marijuana with a medical card. Illinois marijuana dispensaries have very strict security procedures and will check your identification closely when you enter. 

Who is allowed to sell marijuana in Illinois? 

The only entities that can sell marijuana in Illinois are state-licensed dispensaries. State-licensed growers and dispensaries must adhere to very specific rules and regulations. This ensures that the marijuana you purchase from them is high-quality and safe to use. If you are caught selling marijuana privately, you will face legal consequences. 

Where can you consume marijuana legally? 

While marijuana is legal for recreational use, you cannot consume it everywhere. You can legally consume marijuana in your own home as long as minors under the age of 21 are not present. If you rent, check to make sure that your landlord allows smoking or vaping before engaging in either of these activities. 

Legally, you cannot consume marijuana in most bars or public spaces. However, local governments in Illinois do have the option to allow marijuana consumption in certain businesses if they choose. As a result, you may find some smoke shops that allow you to consume marijuana in public, but always be sure to check their licensing first. 

Can you use marijuana while driving?

It is illegal to use marijuana while driving or to drive while under the influence. If you are caught driving under the influence, you could face a license suspension as well as fines up to $2,500. The legal punishment will depend on the severity of the offense and whether you’ve received a DUI before.
