Oregon Qualifying Medical Conditions

Under Oregon medical marijuanas laws, you can apply for medical marijuana card if you have any of the following medical conditions:

    A medical condition or treatment for a medical condition that produces one or more of the following:

        • Cachexia (a weight-loss disease that can be caused by HIV or cancer)
        • Severe pain
        • Severe nausea
        • Seizures, including but not limited to seizures caused by epilepsy
        • Persistent muscle spasms, including but not limited to spasms caused by multiple sclerosis 

      Yes, recreational marijuana is legal in Oregon, thanks to Measure 91, a voter initiative.

      Measure 91 was the third voter initiative seeking to legalize recreational marijuana in the Beaver State following 1986’s Measure 5 and 2012’s Measure 80. Fortunately, voters finally got their wish at the third attempt when Measure 91 passed with 56% of the vote. 

      Following Measure 91, it became legal for adults aged 21 and older to possess and use specified amounts of marijuana.

      The Oregon Liquor and Cannabis Commission regulate cannabis sales in the state, and in the first week, recreational marijuana sales topped $11 million.

      Benefits of an Oregon Medical Marijuana Card

      Since recreational marijuana is legal, do you still need a medical marijuana card? Yes, you do.

      Adults aged 21 and older can buy weed in Oregon but only registered patients can enjoy the exclusive benefits of the Oregon medical marijuana program. These benefits include:

          • Higher possession limits: Cardholders can possess up to twenty-four ounces of marijuana and grow up to six plants, while recreational users can only possess up to eight ounces of marijuana and grow four plants.  
          • Reciprocity: Your medical marijuana card will come in handy if you visit a state where recreational marijuana is illegal but registered out-of-state patients can buy medical marijuana.
          • Cheaper marijuana: Recreational marijuana attracts a 17% state tax, but medical marijuana does not, so if you have a medical marijuana card, you get more for less.
          • Lower age limit: You must be 21 and older to buy recreational marijuana in Oregon, but there is no age limit for medical marijuana. 

        Oregon Marijuana Laws

        Driving is legal, but there are speed limits. And if you break these limits, you’re committing an offense while still engaged in a legal activity. The same analogy applies to possessing weed in Oregon.   

        Possession Limit for Patients and Caregivers

        According to Oregon medical marijuanas law, patients and their caregivers may possess the following:

            • Twenty-four ounces of usable marijuana;
            • Sixteen ounces of a medical cannabinoid product in solid form;
            • Seventy-two ounces of a medical cannabinoid product in liquid form;
            • Sixteen ounces of a cannabinoid concentrate, whether sold alone or contained in an inhalant delivery system;
            • Five grams of a cannabinoid extract, whether sold alone or contained in an inhalant delivery system;
            • Four immature marijuana plants
            • Six mature marijuana plants
            • Fifty seeds. 

          Possession Limit for Recreational Users

          Oregon cannabis laws specify different public and private possession limits for recreational users.

          Adults aged 21 and older can possess the following amount of cannabis in public:  

              • One ounce of usable marijuana (dried leaves and flowers)
              • One ounce of cannabinoid extracts or concentrates (must be purchased from a licensed marijuana retailer)
              • Sixteen ounces of a cannabinoid product in solid form
              • Seventy-two ounces of a cannabinoid product in liquid form
              • Ten marijuana seeds
              • Four immature marijuana plants

            On the other hand, adults aged 21 and older can possess the following amounts of marijuana in private:

                • Eight ounces of usable marijuana (dried leaves and flowers)
                • One ounce of cannabinoid extracts or concentrates (must be purchased from a licensed marijuana retailer)
                • Sixteen ounces of a cannabinoid product in solid form
                • Seventy-two ounces of a cannabinoid product in liquid form
                • Ten Oregon marijuana seeds
                • Four marijuana plants

              You risk fines and jail time if you possess more marijuana than the law allows. 

              Oregon DUI Laws

              Driving under the influence of marijuana is illegal, even if you’re a registered patient, and Oregon medical marijuanas law does not protect you from the penalties.

              Weed laws in Oregon clearly lay out the following punishments:

                  • A first offense for drugged driving is a Class A misdemeanor punishable by a minimum of 48 hours in jail and up to one year in jail, driver’s license suspension for at least 30 days, and $1000 to $6250 in fines.  
                  • A second offense for drugged driving is a Class A misdemeanor punishable by a minimum of 48 hours in jail and up to one year in jail, driver’s license suspension for at least 60 days, and $1000 to $6250 in fines.
                  • A third offense for drugged driving is a Class A misdemeanor punishable by a mandatory minimum of 48 hours in jail and up to one year in jail, driver’s license suspension for at least one year, and $2000 to $6250 in fines.
                  • A fourth offense for drugged driving is a Class C felony punishable by up to five years in jail, driver’s license suspension for at least one year, and $2000 to $125,000 in fines.   

                Yes, CBD is legal in Oregon, according to the 2018 Farm Bill. The Bill states that CBD is legal if obtained from industrial hemp, contains no more than 0.3% THC, and is not advertised as a dietary supplement. 

                What is the Age Limit for Marijuana in Oregon?

                You must be aged 21 or older to buy recreational marijuana in Oregon.

                There is no age limit for medical marijuana, but patients younger than 18 must have a caregiver to help them register for the medical marijuana program and buy marijuana. 

                Can You Grow Weed in Oregon?

                Yes, Oregon marijuana laws allow residents to grow marijuana for personal use.

                Recreational patients can grow four plants per person and household, regardless of the number of adults in the house. So, if there are five people aged 21 and older in the same house, they can grow only four plants, not twenty.

                On the other hand, medical marijuana patients can grow six plants.  

                Can Patients Have Caregivers in Oregon?

                Yes, Oregon medical marijuanas law allows patients to have caregivers, as some patients may be unable to visit dispensaries.

                Basically, a caregiver – who must be aged 18 and older – is responsible for managing the welfare of a registered patient. 

                Patients must list their designated caregivers in their application form, and the caregivers must register and obtain a marijuana card. 

                Where Can I Consume Weed in Oregon?

                Oregon cannabis laws state that it is illegal to consume marijuana in public places. 

                This includes highways and streets, the common areas in residential buildings, schools, parks and playgrounds, and premises used for public passenger transportation like bus stops and amusement parks.

                You also can’t consume marijuana at establishments with a liquor license, like bars and restaurants.  

                With all these restrictions, where can you consume marijuana?

                According to Oregon marijuana laws, your home or private residence is the best place to consume marijuana.

                However, Oregon cannabis laws allow landlords and property owners to prohibit marijuana consumption on their property. So, before you sign that tenancy agreement, ask if the property owner allows marijuana consumption.

                Also, keep cannabis away from federal property. Oregon cannabis laws state that “the use, growing, transportation and possession of marijuana on federal property (including Forest Service, Bureau of Land Management and National Park Service land) remains prohibited.” 

                Can I Lose My Job for Using Marijuana?

                Oregon marijuana laws do not affect employment law. If your employer has a drug-free policy, it’s best to stick with it.

                Does Oregon Have Reciprocity?

                Oregon does not recognize out-of-state MMJ cards; only state residents can benefit from the medical marijuana program.

                Oregon Marijuana Dispensaries

                Only registered dispensaries can sell weed in Oregon, and they abide by the following rules:

                    • They cannot be within 1000 feet of another dispensary or a school
                    • They cannot be located in a residential area
                    • All marijuana exchanges must take place on-site: they cannot operate a mobile service or drive-thru
                    • They cannot share their business premises with another business
                    • They may not package, promote or design their product in a way that appeals to children and adolescents
                    • Minors cannot enter dispensary premises even if they are patients
                    • They cannot sell more marijuana than the legal limit permits
                    • Medical dispensaries can sell only to registered patients
                    • It is illegal to consume marijuana at a dispensary, except if the consumer is an employee who is a registered medical marijuana patient. A registered patient and employee may only consume marijuana out of sight where they are not visible to anyone. They cannot use a consumption system that involves combusting, inhaling, vaporizing, or aerosolizing
