In 2014, Governor Martin O’Malley signed House Bill 881, the Natalie M. LaPrade Medical Marijuana Commission legislation. The bill set up a comprehensive medical marijuana program that protects patients, caregivers, and physicians from prosecution. 

House Bill 881 also created the Maryland Medical Cannabis Commission (MMCC), the body tasked with regulating the purchase, consumption, possession, and distribution of medical marijuana.

Under House Bill 881, registered patients and their designated caregivers can purchase up to a 30-day supply of medical marijuana from licensed dispensaries.

While recreational marijuana is illegal in Maryland, the state has decriminalized possession of small amounts.

Hence, possession of fewer than 10 grams without intent to distribute is only a civil offense that attracts a maximum $100 fine and no jail time.

The Maryland legislature has approved a marijuana legalization referendum that will appear on the November 2022 ballot.

The initiative will ask voters, “Do you favor the legalization of the use of cannabis by an individual who is at least 21 years of age on or after July 1, 2023, in the State of Maryland?”

Voters in Maryland will get the chance to approve or reject the legalization of recreational marijuana. If they vote in favor of the initiative, Maryland will join the rank of states that have full marijuana legalization. 

If voters pass the Maryland recreational marijuana law, adults 21 and older can possess up to 1.5 ounces of cannabis, and it will abolish criminal penalties for possession of up to 2.5 ounces. Also, adults will be able to grow up to two plants at home. 

Under the proposed law, authorities will automatically expunge past convictions for drug offenses that will be legal with recreational marijuana legalization.

There is a good chance that Marylanders will vote to legalize recreational marijuana in November. Why? Because a 2021 poll found that 67% of MD residents support legalizing recreational marijuana.

Because Maryland has decriminalized weed, possessing 10 grams or less of marijuana attracts a maximum $100 fine. However, possessing more than 10 grams in Maryland incurs higher penalties.

If you possess 10 grams to 50 pounds, it is a misdemeanor. The penalty is up to a year in prison and a $1000 maximum fine. 

Also, Maryland classifies possession of 50 pounds or more as a felony, and the penalty is a minimum of five years in jail and a $100,000 maximum fine.

Lastly, possession with intent to distribute is a felony, and the penalty depends on the amount of weed involved.

The Maryland Medical Cannabinoids Commission is in charge of regulating medical marijuana in the state.

According to their website, they oversee policy development, regulations, program implementation, and procedures regarding medical marijuana. They are also in charge of licensing, registration, and inspection.
