Yes, it is. Here’s a rundown of how North Dakota medical marijuana happened.

In 2015, House Bill 1430, which proposed establishing a medical marijuana program, was introduced but voted down. Following the bill’s failure to pass, Fargo resident, Rilie Ray Morgan, began to rally other residents toward putting forth a ballot initiative for the 2016 general election.

The initiative gathered the required number of signatures, and in 2016, voters approved Measure 5, known as the North Dakota Compassion Act.

In 2017, both houses of the North Dakota legislature introduced State Bill 2344 (SB 2344), which modified the medical cannabis act, including removing a provision that allowed medical users to grow their marijuana. Medical marijuana became operational in North Dakota in 2017.

As of 5 April 2022, North Dakota has 7,646 active MMJ cards. 

North Dakota Medical Marijuana Qualifying Conditions 

Residents who suffer from any of the following conditions are eligible to apply for a North Dakota medical card:

ND Medical Marijuanas Application

  • Must be a resident of North Dakota
  • Must be aged 19 years or more
  • Have at least one qualifying condition
  • Have a bonafide relationship with the physician who recommends medical marijuana treatment for you

Minors below 18 years who satisfy all the other conditions can obtain a North Dakota medical marijuanas card, but their parents or legal guardian must apply on their behalf.

What Does a Bona Fide Patient-Doctor Relationship Mean?

According to guidance issued by the North Dakota Department of Health (NDDH), a bonafide relationship is summarized as follows:

  1. The provider has reviewed past medical records and created and maintained their own medical records for the patient.

  1. The provider has completed an in-person medical evaluation of the patient.

  1. The patient is under the provider’s continued care for the debilitating medical condition(s) that qualified them for the program.

  1. Providers will monitor patients while in the program, allowing for follow-up care.

  1. Patients are not seeing the provider for the sole purpose of having a written certification completed. Instead, the patient has established care with the provider for their debilitating medical condition(s).

If your healthcare provider refuses to give you a recommendation for medical marijuana, you can use a different physician. Again, it must be one with whom you share a bonafide relationship.

How to Obtain a Marijuana Card in North Dakota

Now, let’s talk about the steps to getting an ND medical marijuanas card. If you fulfill all the requirements needed to apply, what do you do next? It’s a simple three-step process, and we’ll walk you through it. 

Step 1 – Meet With a Physician 

The first thing you have to do is meet with any ND medical marijuanas doctors with whom you share a bonafide relationship for an evaluation. The doctor will ask you questions based on your medical history and decide if you will benefit from medical marijuana treatment.

If the doctor decides to recommend you for medical marijuana, they will upload the certificate to the state’s Department of Health medical marijuana registry.

Step 2 – Getting Registered

After getting a recommendation for medical marijuana, the next step is to submit the required documentation. These include proof of residency, a state-issued ID, and a $50 fee.

Step 3 – Be Patient! 

After you complete the application process, you’ll get an email confirming the approval or denial of your application. If your application is approved, you’ll receive your North Dakota medical Marijuanas card within 20 days.

The North Dakota Department of Health advises that cardholders renew their cards 45 days before it expires. Renewal applications have the same requirements and process as the original application—patients must obtain a new certification from their health care provider.

North Dakota Recreational Weed Legalization 

Recreational weed is not legal in North Dakota, but there have been several legalization efforts.

In 2018, voters rejected a ballot initiative to legalize North Dakota recreational weed.

In 2019, Governor Doug Burgum decriminalized possession of small amounts of marijuana when he signed House Bill 1050. The bill outlines that adults aged 21 and older who possess up to half an ounce don’t face jail terms, but a penalty of up to $1000 applies. In addition, the bill also reduced the penalty for possession of larger amounts.

In 2020, a voter initiative to legalize recreational marijuana called the North Dakota Freedom of Cannabis Act could not garner the required signatures to make it to the ballot.

Presently, various organizations are working towards legalizing recreational marijuana via ballot initiatives in the 2022 general elections.

Until recreational marijuana is legalized in North Dakota, it’s best to avoid it because the consequences for breaking the law are steep.

Possession of one ounce or less is a misdemeanor punishable by up to 30 days in jail and a fine of up to $1500. If you possess more than one ounce, this is a felony that attracts between 5 years to 10 years imprisonment and a maximum fine of $10,000. 

The possession of any amount close to a school can attract up to 10 years in jail and/or a $20,000 fine. The sale of any amount is punishable by a mandatory 3-year minimum jail sentence.

ND Medical Marijuanas Doctors

What are the rules guiding the conduct of ND medical marijuanas doctors? To begin with, let’s talk about licenses and qualifications.

According to North Dakota law, ND medical marijuanas doctors or healthcare providers must be:

  • A physician licensed by the North Dakota Board of Medicine;
  • A physician assistant licensed by the North Dakota Board of Medicine; or
  • An advanced practice registered nurse licensed by the North Dakota Board of nursing
