    Medical cannabis is legal in North Dakota for qualifying patients. Recreational, or adult-use, cannabis is still illegal, however. 

  • What forms of cannabis are legal?

    In North Dakota, not all forms of cannabis are legal. The state allows for the medical use of:

    • Concentrates or extracts
    • Dried leaves and flowers

  • Who qualifies for a medical card in North Dakota?

    To qualify for a medical card in North Dakota, you must be at least 19 years of age, an in-state resident, and have been diagnosed with at least one qualifying medical condition by a certified physician with whom you have a bonafide relationship.

     

    Minors can receive their MMJ cards if a parent or guardian completes the application. 

  • What are the qualifying conditions?

    The qualifying medical conditions in North Dakota are:

    • Amyotrophic lateral sclerosis (ALS), or Lou Gehrig’s disease

    • Decompensated cirrhosis caused by hepatitis C
    • Ehlers-Danlos syndrome, or elastic skin
    • Endometriosis
    • Epilepsy
    • Fibromyalgia
    • Glaucoma
    • HIV/AIDS
    • Interstitial cystitis
    • Migraine
    • Neuropathy
    • Post-traumatic stress disorder (PTSD)
    • Rheumatoid arthritis
    • Spinal stenosis
    • Terminal illness
    • A chronic or debilitating disease or medical condition on their treatment that produces one or more of the following:
    • Cachexia, or wasting syndrome
    • Intractable nausea
    • Seizures
    • Severe debilitating pain that has not responded to conventional treatment for more than three months, or for which other treatment options produced serious side effects
    • Severe and persistent muscle spasms, including multiple sclerosis

  • What does a ‘bonafide relationship’ mean?

    In North Dakota, the state defines a ‘bonafide relationship’ as:

     

    1. The provider has reviewed past medical records and created and maintained their own medical records for the patient. 
    2. The provider has completed an in-person medical evaluation of the patient. 
    3. The patient is under the provider’s continued care for the debilitating medical condition(s) that qualified the patient for the program.
    4. The patient will have follow-up care and will be monitored while in the program. 
    5. The patient is not seeing the provider for the sole purpose of having a written certification completed. Instead, the patient has established care with the provider for care of their debilitating medical condition(s).

  • Is there a specific amount of time I need to be seeing my primary care physician?

    No, the requirements for a bonafide patient-doctor relationship are defined above.
