What Is the Marijuana Possession Law in West Virginia? 

If you possess any amount of marijuana, you are facing a potential sentence of three to six months and a fine of up to $1,000. First-time offenders who possess less than 15 grams of marijuana could be given probation with regular drug testing and supervision throughout that process.

If the intent of the possession is to distribute marijuana, you are looking into anywhere from one to five years of imprisonment and a fine of up to $15,000.

Can You Legally Grow Marijuana in West Virginia?

Marijuana is legal in West Virginia, but you cannot grow it yourself.
