Is there medical marijuana in Mississippi?
Yes, there is medical marijuana in Mississippi! (Or at least, there will be soon.) Those who demonstrate qualifying medical conditions and obtain a proper recommendation can legally get their hands on Mississippi medical marijuana likely starting by the end of the year.
The Magnolia State first legalized a form of MMJ back in 2014 with Harper Grace’s Law. This legislation allowed those with debilitating epilepsy or seizure disorders to get their hands on CBD oil and resin. However, these products couldn’t contain more than 0.5% THC.
Six years later, residents of Mississippi voted to pass Initiative 65: a bill that legalized medical cannabis for those with qualifying medical conditions. Unfortunately, Initiative 65 didn’t make it far. Madison’s mayor argued to invalidate the bill, despite the fact that over 70% of voters voted in favor of the bill. Regardless, Initiative 65 was killed.
It wasn’t until February of 2022 that the Mississippi legislature finally passed a comprehensive medical marijuana program. This bill, called SB 2095, legalized medical cannabis for qualifying patients and outlined possession, cultivation, and caregiver laws. Now, the state expects to see the program fully in effect by the end of 2022.
Is marijuana legal in Mississippi?
Cannabis, in general, is not legal in Mississippi — only medical marijuana is legal. However, the state has decriminalized some amounts of cannabis. Thus, possession of up to an ounce of cannabis will get you a fine of $100 to $250 for your first offense.
Can you get a medical marijuana card in Mississippi?
Right now, you cannot yet get your medical marijuana card in Mississippi. However, this should change in the near future. The Mississippi State Department of Health claims that their medical card application process will begin June 2022 and that patients will only have a five-day approval time for the MMJ program.
The MSDH also anticipates giving out proper licensing by the summer of 2022 and having products available by the end of the year. But, we will simply have to wait and see.
Can people in Mississippi get marijuana for medical reasons?
Yes, people in Mississippi can only get marijuana for medical reasons once the program is fully unveiled. Currently, recreational cannabis is not yet legal in the Hospitality State.

How to get a hemp growing license in Mississippi
When the MS MMJ program becomes fully operational in the summer of 2022, you will apply through the MSDH website to get a growing license. However, you’ll have to wait until June to do so.
How to find a medical marijuana caregiver in Mississippi
Finding a medical marijuana caregiver in Mississippi is easy. Typically, those who are underage will have their parent or guardian act as a caregiver. If you’re elderly and have a caregiver at home, this person can also act as your MMJ caregiver. They just have to have the following qualifications:
- Be at least 21 years old
- Be a current Mississippi resident
- Don’t have any license, ID, or state-issued document that the MMJ program has revoked
- Cannot have been convicted of a disqualifying criminal condition in the last five years
- If they have a medical license, the license must be in good standing
- Cannot already be a caregiver to a qualified patient
Once Mississippi medical marijuana patient applications open this summer, so will the applications for caregivers.
When will Mississippi dispensaries open?
Unfortunately, we cannot say for sure when Mississippi dispensaries will open. Right now, the state plans on giving out licenses for dispensary owners in June of 2022. The MSDH has optimistically stated that they believe patients will be able to purchase products by the end of the year. However, opening up dispensaries in Mississippi could easily take longer than that.
