Legality of Marijuana in Michigan

While cannabis legality in some states may be juxtaposing and confusing, this isn’t the case for Michigan. Plain and simple, marijuana is legal in the Great Lake State. 

Of course, this doesn’t mean it comes without regulations; but, the state has long been versed in the intricacies behind a medical cannabis program. Let’s get into it. 

Yes, recreational marijuana is legal in Michigan and has been since 2018. Years after legalizing medical cannabis, residents of MI finally voted to legalize adult-use cannabis for those 21 years and older through the Michigan Regulation and Taxation of Marihuana Act

Recreational legalization brought more in-depth regulations and marijuana laws. The state crafted unique regulations for recreational cannabis — ones different than that of medical cannabis — to still ensure that the state’s MMJ program ran flawlessly alongside adult-use legalization. 

A decade before Michigan decided to legalize recreational cannabis, they legalized medical marijuana. Michigan medical marijuana has been legal since 2008 when residents approved the Michigan Compassionate Care Initiative. This act legalized medical cannabis consumption for patients who were seriously or terminally ill. It even permitted patients and caregivers to grow their own MMJ, too. 

Today, you can get a Michigan medical marijuana card if you have one of the following medical conditions:

Growing Marijuana in Michigan

Is it legal to grow marijuana in Michigan? It absolutely is — for both patients and recreational consumers. 

Michigan medical marijuana growing laws allow medical patients and adult-use consumers to grow their own marijuana plants at home. If you choose to do so, you have to follow the strict rules and regulations that the MMMP has put in place regarding at-home cultivation. 

When you’re growing medical marijuana in Michigan, you have to make sure that you keep your plants locked away, secured in an enclosed space. The public and those who are under age should not be able to have access to these areas. 

How Many Marijuana Plants Can I Grow?

Okay, so how many marijuana plants can you grow in Michigan? 

Michigan marijuana laws state that adult-use consumers can cultivate up to 12 cannabis plants at one time, possessing up to 10 ounces of product from those plants. You’re allowed to give away small amounts of your bud, but you cannot sell it unless you have a license. 

If you’re a medical patient, you’re also allowed to cultivate up to 12 cannabis plants at one time. With an MMJ card, you can possess a total of 10 ounces from your home-grown plant. However, when applying for your card, you have to let the state know your intent to cultivate.    

Marijuana Possession in Michigan

Just like cultivation, Michigan marijuana laws have their own regulations regarding possession limits. 

As we established above, both patients and adult-use consumers can possess up to 10 ounces of cannabis in their home, harvested from personal cannabis plants. However, for adult-use consumers, this strictly applies to at-home cultivation limits.  

Does Michigan Have a Purchase Limit? 

Michigan does have a purchase limit for cannabis. Adult-use consumers can only purchase and possess up to 2.5 ounces (no more than 15 grams of that be in concentrate form) on their person at one time. If you try to buy more than this at once, you will be turned down from the dispensary. You cannot try to buy more from a different dispensary, either. 

Medical patients, on the other hand, can purchase up to 10 ounces of cannabis per month, with every patient having a 2.5 purchasing limit per day. If you require more, you may be able to reach out to the MMMP to get a larger allotment. 

How Much Marijuana Can I Possess in Public?

Just like with the purchase limits, you cannot possess more than 2.5 ounces of cannabis in public. In general, public consumption of cannabis is illegal; however, if you’re transporting it in your vehicle, for example, you cannot have more than 2.5 ounces on you at one time. It doesn’t matter whether you’re a medical patient or not.  

Where Can I Use Marijuana Legally in Michigan?

According to Michigan marijuana laws, you can only consume cannabis in your home or within a private space. You cannot consume your products in any public areas unless they have explicitly stated otherwise.

If you rent your property, you must get permission from your landlord to consume cannabis there. You also cannot consume your products in a privately owned vehicle, and driving after consumption is against the law.

Cannabis Reciprocity in Michigan

Unfortunately, Michigan doesn’t offer cannabis reciprocity for out-of-state medical patients. However, as long as you’re at least 21 years old, you can still walk into a dispensary and purchase cannabis products.
