In Texas, medical marijuana is legal for qualifying patients who have received a prescription from their doctor. 

The state legalized medical marijuana in 2019 with the passage of House Bill 3703, which allows patients with specific debilitating medical conditions to access cannabis products containing low amounts of tetrahydrocannabinol (THC).

Recreational marijuana is not legal in Texas. Possession of less than two ounces of marijuana is considered a Class B misdemeanor and may result in up to 180 days in jail and/or a $2,000 fine. 

Possession of more than two ounces but less than four ounces is considered a Class A misdemeanor and may result in up to one year in jail and/or a $4,000 fine. 

More severe penalties are applied for possession of more than four ounces or the sale or distribution of any amount of marijuana. In some cases, felony charges may apply under certain conditions.

To be eligible to receive a prescription for low-THC cannabis products, you must demonstrate your proof of residency, as well as your age. (Though, if you’re a minor, you can still get your card — just with a caregiver.) 

You do not have to pay any state fee for a Texas medical marijuana card.

Texas is holding strong on its stance on the illegality of this crop. However, if the plant is dried and doesn’t have more than 0.3% weight of THC, then it is considered to be hemp and is not unlawful. 

There is some gray area in this legal matter because there isn’t a specific law stating that the growing of marijuana is illegal. However, Texas authorities consider “growing” as “possession.”
