Surprise! You don’t actually need a medical card like other states, but you still have to follow a process in order to access the very limited medical cannabis in Texas.

Texas is one of many states that have passed the Compassionate Use Act, meaning that those with qualifying conditions can purchase, possess, and use cannabis or marijuana products to aid in their symptoms. Although medical marijuana has been legally approved in Texas, Texas medical marijuana laws governing the use of cannabis are still extremely strict. 

As with any product that is legal in some areas or instances but not in others, it’s important to have as much information as possible before growing, purchasing, delivering, or partaking. Specifically, regarding marijuana, laws have changed over the past few years and are still vastly different from state to state. 

Let’s look at some of the specifications in Texas regarding who can use, grow, and possess medical marijuana and how to obtain it. You don’t want to be caught with something that you thought was legal for your situation but actually isn’t because the process to extricate yourself could be lengthy and difficult. 

Medical Marijuana Cards in Texas

The term “medical marijuana card” is used in many places to refer to one’s legal right to possess marijuana or cannabis for aid in the symptoms of certain medical conditions. Although Texas does allow for the medical use of marijuana, its laws are very strict. Also, the dispensaries at which you can get your Texas medical marijuana prescription filled are few and far between. It is also illegal to purchase marijuana products in other states and bring them back into Texas. 

For all these reasons, in Texas, a medical marijuana card with the user’s identification information and a picture is not a tangible document. Instead, the patient needs to obtain a qualifying prescription from a physician registered with Texas’ Compassionate Use Program. The prescription is then uploaded to an electronic database (by the physician), and then the patient (or their caregiver) can pick it up at one of Texas’ local dispensaries. 

Is Marijuana Legal in Texas for Medicinal Use?

In Texas, the state’s Compassionate Use Program (CUP) allows physicians to prescribe low-THC products for medical use. However, any product being sold or used in Texas must contain no more than 0.5% THC (by weight), and all products must be available to be taken in edible form, not smoked. 

In 2021, a bill passed that raised the allowable amount of THC in medical marijuana products from 0.5% to 1.0%. This has yet to make it through Texas law, though.

Is Recreational Marijuana Legal in Texas?

The short answer is no. In Texas, THC (or tetrahydrocannabinol) products are considered a Group 2 penalty. This means that delivering or possessing marijuana (without a medical marijuana prescription) is a criminal offense. Depending on the amount being delivered or in the citizen’s possession, the penalty varies. It is sometimes charged as a misdemeanor but could be a felony, depending on the situation. 

How to Apply for a Medical Marijuana Card in Texas

Although recreational use of marijuana is illegal in Texas, there are millions of Texas residents who need and qualify for medical marijuana prescriptions. To use this privilege, though, you must have a prescription from a doctor registered with the Texas Compassionate Use Program. 

Actual “medical marijuana cards” aren’t used in Texas. Instead, a patient’s prescription is uploaded to an online database, CURT, with the physician’s credentials.  

Who Qualifies for Medical Marijuana Cards in Texas?

In Texas, you may only partake in the CUP if you have one of the following conditions:

To be eligible to receive a prescription for low-THC cannabis products, you must: 

  • Permanently reside in Texas
  • Currently suffer from one of the above-listed conditions
  • See a CUP-registered physician to diagnose your condition
    • This physician must confirm that the benefits of low-THC products outweigh the risk. 

There is no age limit to who can qualify for cannabis prescriptions in Texas; however, those patients under the age of 18 will need a legal guardian to sign off on their paperwork. Even though Texas laws regarding medical marijuana are so stringent, the age requirement is one place where there is a large amount of leniency.

The process for receiving a valid prescription for medical marijuana in Texas is as follows:

  • The qualifying physician enters the prescription in the Texas CUP Compassionate Use Registry of Texas (CURT).
  • Once it is approved, the patient can fill their prescription at any licensed Texas dispensary.
  • When picking up the allowed prescription, the patient (or their legal guardian) must have the patient’s ID card, full name and date of birth, and last five digits of their SSN. 

Remember, Texas residents needing medical marijuana don’t receive tangible cards like in other states. Their doctor will upload their prescription into a database, and then the patient can fulfill that prescription at legal dispensaries. 

It is the patient’s responsibility to notify the dispensary that their doctor has uploaded their prescription. 

Medical Marijuana Doctors in Texas

In order to provide prescriptions for medical marijuana in Texas, a physician must follow the process outlined in Texas law. They must register with the CURT program, and then they can add patients to their physician profile. 

For each patient, the physician can add treatment plans, safety and efficacy information, and specific prescription details. 

Most doctors who prescribe medical marijuana in Texas offer virtual appointments. During that appointment, they will verify your condition and information and then upload your prescription to the electronic database. 

Although there are only a few legal dispensaries in Texas, those physicians registered with CURT and able to provide medical marijuana prescriptions are abundant. You simply need to search for medical marijuana doctors and find one with availability. That being said, it is always smart to vet your doctor before seeing them. Read reviews, get real-life experiences from friends or family members when available, and make sure that the doctor you choose is licensed and insured. 

It is your responsibility to cover your bases and make sure that you are receiving care from someone who is legally allowed to offer it to you. You also deserve to receive care from someone experienced, professional, and who knows how to accurately prescribe marijuana for a range of conditions. Not every condition, symptom, or body is the same, so it will behoove you to choose a medical professional who is highly trained and who has been practicing and prescribing medical marijuana for a long time. 

Texas Medical Marijuana Laws

Texas has very strict laws regarding the medical use of cannabis. Products must only be consumed in swallowing form—not smoked—and must be prescribed by a physician registered with Texas’ CURT program. 

All medical marijuana products must have less than 0.5% by weight of THC and must be obtained through a legal dispensary. 

Any other use of cannabis or marijuana in Texas is illegal. Those possessing large amounts or who are caught providing marijuana to an unqualified minor can even be charged with a felony.

That being said, most Texas legal authorities don’t have the appropriate equipment to measure how much THC a cannabis product contains. This means that they tend to err on the side of caution (for them) if they find out that a patient has possession of any cannabis product.  

Some states do not allow for the purchase of cannabis products within their borders, but possession is allowed. Texas, however, is not one of these. Remember that purchasing marijuana products in a legal state and bringing them into Texas territory is considered drug trafficking and is punishable as a severe offense. 

How to Grow Medical Marijuana in Texas

Although many other states have made it legal to grow marijuana for medical use, Texas is holding strong on its stance on the illegality of this crop. However, if the plant is dried and doesn’t have more than 0.3% weight of THC, then it is considered to be hemp and is not unlawful. 

There is some gray area in this legal matter because there isn’t a specific law stating that the growing of marijuana is illegal. However, Texas authorities consider “growing” as “possession.” 

Medical Marijuana Dispensaries in Texas

Since Texas has such strict laws regarding medical marijuana, there are only three dispensaries licensed in the entire state of Texas, and only one that is owned and operated in the state itself. Each of these dispensaries has several locations, though, and some offer delivery to your home. 

The three companies that are legally allowed to cultivate, process, and dispense medical marijuana in Texas are Compassionate Cultivation (which has its warehouse in Manchaca), Consortium Texas (based out of Schulenburg), and Surterra Texas (based out of Austin).
