Is delta-8 legal in the states I am traveling to and from?

Hemp-derived delta 8 containing 0.3% THC or less is federally legal. Unless a state has made specific laws to prohibit it (which many of them have), delta 8 doesn’t violate any federal laws.

Has the airline specifically prohibited flying with delta-8?

TSA’s medical marijuana regulations don’t specifically discuss delta-8 THC, but they do mention that medical marijuana products are federally illegal except for “products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA.” 

By that, TSA is referring to hemp-derived products made federally legal by the 2018 Farm Bill – which includes delta 8 THC. Since delta 8 THC doesn’t violate federal law, you should be in the clear with TSA to be flying with these products.

However, it’s still smart to check with the specific airline you are using.

Is my delta 8 product hemp-derived and federally legal, containing 0.3% THC or less?

If you purchased your delta 8 product from a credible retailer, your delta 8 product is likely legal. Double-check the ingredients to confirm that it contains 0.3% THC or less.

Steer clear from purchasing any cannabis product from an unreputable source, like a random gas station or sketchy website. Look for ingredients, COAs provided by third-party testing, and customer reviews if buying online.

Can You Fly With Delta 8 Gummies?

As long as your delta 8 gummies follow the three guidelines above, you can legally fly with them.

According to TSA’s food guidelines, passengers can bring solid food items like candy in a carry-on or checked bag.

Flying With Delta 8 Vape

If your delta 8 vape complies with the flight regulations and you adhere to the airline’s rules for storage during the journey, it is legally permissible to travel with it.

According to TSA’s vaping devices guidelines, electronic smoking devices are allowed only in carry-on baggage. So you cannot put vapes in your checked bag. 

TSA requires that you take “effective measures for preventing accidental activation of the heating element of the device” during the flight. This could include removing the battery or putting the vape in a protective case.

Can You Fly with a Delta 8 Tincture?

Depending on the container’s size, travelers can bring hemp-derived delta 8 tinctures on flights, either in their carry-on or checked luggage. 

The Transportation Security Administration (TSA) mandates that liquids in carry-ons must be in containers of 3.4 ounces or smaller. Containers larger than this must be in checked baggage.

What is Delta 8 THC?

If you plan on flying with delta 8, knowing what it is and its laws is essential. First off, what is delta 8 THC?

Delta 8 THC is a THC isomer, meaning it has the same chemical formula as delta-9 THC but with a different atomic structure.

Delta 8 is approximately two-thirds as potent as delta-9 THC. Studies suggest that delta-8 consumers experience relaxation, euphoria, pain relief, and reduced inflammation. Compared to delta-9 THC,delta-8 is less likely to cause anxiety or paranoia.

Is Delta 8 Legal?

Thanks to the 2018 Farm Bill, hemp-derived delta 8 THC containing 0.3% THC or less is federally legal. However, on a state level, this could vary. Some states have implemented specific laws prohibiting delta 8.
