West Virginia Medical Marijuana

Medical marijuana was legalized in West Virginia in 2017. West Virginia medical cannabis products are available for patients with qualifying medical conditions. You’ll need a West Virginia medical card in order to visit a dispensary in the Mountain State. Here’s everything you need to know about West Virginia medical marijuana laws and how to get your WV medical card.

Is marijuana legal in West Virginia?

Is weed legal in West Virginia? While marijuana was completely illegal in West Virginia for decades, the state government passed legislation to start a medical marijuana program in 2017. The program officially launched in 2019. Now that marijuana is legalized in West Virginia, patients have many options when it comes to care for chronic illnesses.

While medical marijuana is legal, recreational marijuana in West Virginia is currently illegal. Possession of small amounts of marijuana for recreational purposes is a misdemeanor and can come with legal consequences. Since many other states have legalized medical marijuana, there is a precedent for this to change in the future. However, there aren’t currently any recreational West Virginia legalization initiatives.

How To Get A Medical Card in West Virginia

How do I get a medical marijuana card? The process of getting your first medical marijuana card  may feel daunting, but it doesn’t have to be. Once you find a licensed medical marijuana doctor in your area, they can help you through the process.

To apply for a medical card in WV, you’ll need to have one of the state’s qualifying medical conditions. If you believe that you may qualify, the next step is to find a doctor that is registered with the West Virginia Bureau of Health to prescribe medical marijuana. Elevate Holistics offers appointments with WV medical marijuana doctors online, so you can get your medical marijuana card without leaving your house. In fact, you can get a medical marijuana card online without having to do any in-person appointments.

If the doctors determines that you qualify for a medical marijuana card, they will fill out a patient certification form for you. Then, you will need to go online and create an account with the West Virginia Department of Health and Human Resources. You’ll need to complete a basic application form and pay the application fee of $50. Fee waivers are available for patients who can prove financial hardship.

The West Virginia government will review your application within 30 to 60 days. If your application is approved, you will be notified by email and will receive your West Virginia medical marijuana card in the mail. They will also let you know if your application is denied for any reason or needs a correction.

Qualifying Conditions For WV Medical Card

West Virginia currently approves medical marijuana cards for patients that have approved chronic health conditions. These conditions have been proven to benefit from medical marijuana treatment.

Right now, the approved conditions under West Virginia marijuana laws are cancer, HIV/AIDS, Multiple Sclerosis, Parkinson’s disease, ALS, epilepsy, Huntington’s disease, Crohn’s disease, PTSD, neuropathies, damage to the nervous tissue of the spinal cord, sickle cell anemia, and intractable seizures. You may also qualify for a medical card if you suffer from severe chronic or intractable pain, or if you have a terminal illness with a year or less life expectancy.

Many people do not realize that they qualify for a medical card in West Virginia. If you think you have pain or chronic illness symptoms that are severe enough for medical marijuana treatment, it can help to talk to a doctor and learn more about your options.

West Virginia Dispensaries

Once you have your medical marijuana card, you can purchase the cannabis products you need at a West Virginia dispensary. There are dispensaries located throughout the state of West Virginia, with options in major cities and small towns.

When you visit the dispensary, you will need to check in with your medical marijuana card and government-issued ID. Many dispensaries encourage new patients to call ahead to speed up the check-in process. While inside the dispensary, you’ll be able to browse a wide variety of products. The staff is available to answer any questions you may have about the products. They can help you find the right strain, dose, and form of cannabis for your preferences. You may also want to talk to your doctor ahead of time to see what dosage they recommend.

Right now, West Virginia medical marijuana patients can only purchase a 30 day supply of product at one time. A 30 day supply is going to look different for every patient and therefore must be defined by your doctor ahead of time.

Are edibles legal in WV?

Many people wonder – is weed legal in WV? What kinds of products are available there? When it comes to choosing cannabis products, many people prefer edibles, oils, or drinks to smoking or vaping. You can still enjoy the health benefits of marijuana if you smoke, but there are also some risks that come along with it. Luckily, edibles are legal according to WV weed laws.

When visiting the dispensary, you can talk to the staff to determine which edibles will be best for your needs. Edibles come in varying dosages, strains, and ratios. For example, many people prefer edibles with a high amount of CBD in them.

It’s important to note that you won’t start to feel the effects of an edible right away. Edibles typically take 30 to 90 minutes to kick in, depending on when you consume them. This is a different feeling from smoking or vaping, where you will start to notice the sensation right away.

How much does medical marijuana cost?

It’s important to note that getting medical marijuana in WV comes with a price tag. The medical marijuana card cost is $50 for most West Virginia residents. If you can prove financial hardship, the state will waive this fee for you. Additionally, you will need to pay for your appointment with a medical marijuana doctor. Since marijuana is not yet legal on a federal level, health insurance does not cover any appointments or services relating to marijuana. The cost of your appointment can vary depending on your provider. Elevate Holistics offers telehealth medical marijuana appointments starting at $75.

The cost of the actual marijuana products you are purchasing will vary. Price is dependent on a variety of different factors, including the type, brand, and amount you are purchasing, as well as the dispensary you are purchasing from. Medical marijuana generally costs $20-60 for either an eighth of flower or a gram of concentrate.

What are the caregiver rules?

West Virginia weed laws allow patients under the age of 18 with qualifying conditions to purchase medical marijuana with the help of a caregiver. Adult patients who are physically unable to make it to the dispensary can also use a caregiver. The caregiver is able to visit the dispensary and purchase products for the patient, but they cannot use marijuana themselves.

In order to be a caregiver, you must be over the age of 21 and a resident of the state of West Virginia. Caregivers will need to pass a criminal background check as part of their application. Each patient can designate up to two caregivers, and a registered caregiver can have up to five patients.

The application process for caregivers is very similar to the one that patients go through. A doctor will need to confirm that the patient has a chronic condition and needs a provider. The caregiver will then need to apply online and pay the same fees that the patient does.

Can I grow marijuana at home?

If you use medical marijuana frequently, you may be wondering if you can grow your own cannabis plants at home. Unfortunately, growing marijuana plants is not allowed, despite medical marijuana legalization in West Virginia. If you are caught growing your own marijuana, you could face serious legal consequences. These can include fines or even jail time.

Other states do allow medical marijuana patients to grow their own plants, so this could change in the future in West Virginia. For the time being, however, you’ll need to stick to buying your cannabis from a licensed dispensary. Right now, there are 10 licensed cannabis growers in West Virginia, with the possibility for expansion later on.

Can I renew my medical card online?

West Virginia medical marijuana cards last for one year, after which they will expire. You will need to get a new certification from a licensed medical marijuana doctor. The process for renewing your card is very similar to registering for the first time. You will need to complete a form online and then pay the $50 registration fee.

To ensure that you have continuous access to medical marijuana, you’ll want to start the renewal process before your card expires. The West Virginia Bureau of Health is relatively slow when processing applications. Patients should expect processing times of a month or more.
